Probate and TrustsWhen someone dies, whether they had a will or not, the estate needs to be probated to ensure creditors are paid and that beneficiaries inherit what they are entitled to, according to the will, living trust, or state law when there is no will or trust.

If you are involved in probating an estate, we can help. Contact the lawyers of Miller, Walsh & Kutz to schedule a free initial consultation about our estate, probate, and trust administration services. Call us any time, day or night--at 757-595-0123. You may also contact us online, and someone will be in touch with you soon.

Settling an estate is a specialized service involving a high degree of trust and personal attention to detail.

Whether you are the trustee under a trust, the executor under a will,  or the administrator of the estate of one who died without a will, as the personal representative, you are responsible and liable for:

  • The collection, preservation and accounting of all estate assets
  • The payment of all taxes, debts and other obligations of the deceased
  • The distribution of the estate assets according to the will or state law when there is no will.

Furthermore, you must meet deadlines for filings with the court, Commissioner of Accounts and federal and state taxing authorities and you are required to account for estate assets to the penny.

Our attorneys have years of experience probating decedents’ estates under the supervision of the Commissioner of Accounts, either as the personal representative of the deceased or as the attorney for the deceased’s representative.

It’s important to note that a trustee, in comparison to an estate administer, may need to manage the account for many years, conserving the property while still using it for the beneficiaries’ needs. If you are a trustee, we’ll help you distribute funds to beneficiaries, as permitted in the trust document. Additionally, our attorneys can help you submit annual accountings to the Commissioner of Accounts for the property and file the trust’s federal and state income taxes.

These matters are complicated, and need to be handled meticulously. If you need help administering a will or trust, call the asset protection attorneys of Miller, Walsh & Kutz now for a free consultation with an attorney.
